העבודה הוגשה במסגרת קורס באנגלית – משפט וכלכלה מתקדמים (תורת המשחקים והחוק) , קיבלה ציון של 98!

העבודה מנתחת באופן ייחודי מקרה משפטי – פס"ד נחום נ' בן הרוש ומיישמת את הניתוח על תורת המשחקים בדיני משפט וכלכלה.

העבודה מעניקה, בין היתר, ניתוח אנלוגי וברור לפתרון בעיית דילמה פתולוגית וסחטנות קבוצתית באמצעות ניתוח מעמיק של פסק דין המתואר לעיל, ובאמצעות ניחוח של חוק ההתחדשות העירונית, מההיבט המשפטי וכן מעניקה ניתוח מעמיק של המשחק הכלכלי, הכולל אחוזים, אסטרטגיות אפשריות, חלופות וטבלה ברורה ומתאימה, כאשר התוצאה הסופית הינה פתרון נרחב ומנומק.

A. The Assumptions:
In order to get a better understanding of the Court's decision in the case above, I have laid down some ground theoretical assumptions:
(a) In order to get the building into the urban renewal project, there is a need of 85% consent.
(b) The players in this game are 20% of the apartment owners. Without the consent of at least one of them the project cannot materialize.
(c) The value of one new standard apartment is 2m shekels.
(d) The value of a penthouse apartment in the building that is not offered to the owners, as a part of urban renewal project, is 3m shekels.
(e) If the player remains as sole refuser, he will get nothing.
B. The rules:
(a) In order to get an ordinary apartment, each of the owners can sign separately, without the need to coordinate between them.
(b) In order to get a penthouse, they need to "work" together, and be refusers, because without both of them the project will not materialize.
(c) The owners can coordinate between them.
